Independent Contractor Agreement (version 2026-10-07) between MyKidIsBad.com (the “Company”) and the person who signs below (“Contractor”).
1. Independent contractor relationship
Contractor is an independent contractor, not an employee, partner or agent of the Company. Contractor decides if, when and how much to work. The Company does not set a schedule, require minimum hours, or require Contractor to accept any task. Contractor uses their own device, internet connection and workspace and is responsible for their own methods, within the quality and safety standards in Section 5. Contractor may work for others, including similar services, subject to Sections 6 and 7.
2. Services and pay
Services are the content review and member support tasks available in the Team dashboard (“Services”). The Company pays the hourly rate shown in the Contractor’s Team account for time Contractor records while clocked in and the Company approves. Pay periods are two weeks (every other week), with payment planned about five days after a period ends. Time must be recorded honestly; only time actually spent working is payable. The Company may correct obviously wrong entries and will tell Contractor why. The Company may change a rate for future work with notice. Contractor may stop working or end this agreement at any time, and so may the Company (Section 10).
3. Taxes, no benefits
Contractor is responsible for all taxes on payments received, including income and self-employment tax. The Company does not withhold taxes, except where the law requires (for example backup withholding if a valid taxpayer ID is not provided). Before the first payment, Contractor must give a completed Form W-9 through the Team dashboard. The Company will report payments to Contractor and the IRS where required (Form 1099-NEC). Contractor is not entitled to employee benefits, paid leave, overtime, or participation in any Company plan. Contractor is responsible for any business licenses, insurance, and required registrations. Contractor understands that state law may affect classification and that Contractor should seek their own tax and legal advice.
4. Records
The Company keeps time, pay, W-9 and activity records for at least four years, or longer if the law requires. Taxpayer ID numbers are stored encrypted.
5. Member safety, children and privacy
Contractor will follow the Community Guidelines and the Team Guide. Contractor may see content written by parents about their children. Contractor must: keep everything seen in the Team dashboard confidential; use it only to do the Services; never copy, screenshot, save, share, or discuss it outside the dashboard; never try to identify a member or child, find their contact details, or contact a member outside the platform; never collect or use children’s personal information; and report any suspected danger to a child to the Company immediately using the escalation steps in the Team Guide. The Company designs the Service so Contractors do not see member email addresses or children’s profiles unless specifically authorized for support tasks. Contractor will comply with the Company’s privacy policies and applicable privacy laws, including those protecting children.
6. Confidentiality
Contractor will keep confidential all non-public information about the Company, its members, its systems, and its processes, during and after this agreement, except what the law allows to be disclosed. Nothing in this agreement prevents Contractor from reporting a possible violation of law to a government agency, discussing pay or working conditions as the law allows, or making disclosures protected by whistleblower laws.
7. Ownership of work
Work Contractor creates for the Company in the Services (such as written replies and notes) belongs to the Company. Contractor assigns to the Company all rights in that work and promises it will be original and not copied from others. Contractor keeps their own tools, general knowledge and skills.
8. Conduct and security
Contractor will keep their password private, use a strong unique password, not share their account, sign out on shared devices, and report any suspected unauthorized access immediately. Contractor must not use the access for any personal purpose, harass or discriminate against any member, or take any action in bad faith. Actions in the Team dashboard are logged.
9. No guarantees; limits
The Company does not guarantee any amount of work. The Services are provided as is, and the Company is not responsible for lost opportunities if work is not available.
10. Ending this agreement
Either side may end this agreement at any time for any reason by telling the other. The Company may immediately suspend access for security or safety reasons. On ending, Contractor will stop using the dashboard, and the Company will pay for all approved time worked. Sections 3, 4, 5, 6, 7 and 11 continue after the agreement ends.
11. General
This is the entire agreement about the Services. Changes must be agreed in writing, including by accepting a new version electronically. If a part is found unenforceable, the rest stays in effect. This agreement is governed by the laws of [STATE — to be set by the Company with its attorney], and disputes will be handled as provided by [DISPUTE RESOLUTION TERMS — to be set by the Company with its attorney].
